INDUSTRY SPECIFIC – NOTEWORTHY TIDBITS
Agriculture
US Dept. of Agriculture

Farms - the U.S. Environmental Protection Agency (EPA) has laws and regulations

Most of these apply to effluent releases from animal waste and fertilizer run-off and minerals leaching.
A current program is in place for voluntary installation of buffers to reduce flow of nitrogen and phosphorus into water sheds, creeks and streams, and water ways that spill into the Chesapeake Bay. (Congressional efforts to make mandatory regulations have been attempted. Failure of a robust voluntary program may ultimately result in enactment of Federal regulations.)
Farms with over 700 cows are required to comply with EPA rules regarding agriculture runoff.
Poultry farms are required to obtain a federal pollution discharge permit (also known as a wastewater discharge permit) from the U.S. EPA. if manure from their operations runs into a drainage ditch and/or stream.
The Occupational Safety and Health Administration (OSHA) also sets guidelines to protect
poultry workers from respiratory and infectious diseases. (www.osha.gov)
Import/Export laws (via Dept of Agriculture) apply to trade of livestock across international
borders. Related laws also apply to plants and produce traded across international borders.
Farmers Markets – if not a federally sponsored farmer’s market, the association or “owner” may establish its own rules. State food and agriculture regulations apply. If prepared foods are offered, federal food handling regulations apply. Vendors and Market “owner” should cover themselves with liability insurance.
Energy
Retail sales of wind, solar and other alternative energy sources are regulated by the West Virginia Public Service Commission. (www.psc.state.wv.us)
Wholesale sales of electricity from any power source, including renewable, across state lines is
regulated by the Federal Energy Regulatory Commission. (www.ferc.gov)
Local power sources such as a windmills or biomass projects erected to power on site
operations such as a home, farm or factory may be subject to approval from fish and wildlife.
Telecommunications
Establishment of a telecommunications company that accesses broadband spectrum is under
the oversight and regulations of the Federal Communications Commission.
Establishment of a wireless telephone store only requires local and state retail licenses.
Industrial/Factory
Federal regulations impacting an industrial business corresponds to the type of business
and whether any hazardous materials and/or regulated effluents (gasses, wastes, etc.) are
associated with the operation.
In most cases, any industrial wastes or effluents would be regulated by the U.S. EPA. Check
with their website www.epa.gov to determine whether your operations fall under EPA oversight.
Medical Service
Any medical facility that generates biomedical waste (blood, needles, body fluids) must comply
with disposal regulations under the U.S. EPA.
Radioactive materials and waste (usually from X-ray machines and chemotherapy radiation
devices) are regulated by the Nuclear Regulatory Commission.
Transportation of EPA and NRC regulated materials (e.g., biomedical waste and radioactive
waste) must be tracked and documented via federally acceptable tracking manifests.
